Terms of Service
Effective 25 August 2026.
These terms are the agreement between Commish Pulse LLC, an Oklahoma company (“we”, “us”), and the agency subscribing to CommishPulse (“you”, “your agency”). By creating an account or paying a subscription, you accept them.
Section 12 limits what we owe you if something goes wrong, and Section 6 is the one that costs money. Both are written plainly for that reason.
1. What CommishPulse is
CommishPulse records insurance policies your agency has written and calculates the commission owed on them, from rates you configure.
It is a record-keeping and reporting tool. It is not:
- an accounting system, a general ledger, or a payroll system
- a system of record for your carrier relationships
- a compliance, tax, or legal product
- a source of truth for what a carrier actually owes you
Commission figures it produces are calculations from rates you entered, not statements of what anyone owes. Before paying anybody on the strength of a number in CommishPulse, reconcile it against your carrier statements. This is the single most important sentence in this agreement.
2. Your account
You need an account to use the service. You are responsible for the accuracy of what you enter, for keeping credentials secure, and for everything done under your account.
An owner can see the whole agency’s book and administer it. A producer sees only their own business. You decide who is which, and you are responsible for that decision.
Tell us promptly if you believe an account has been compromised.
3. Your data stays yours
You own everything you put in. Every policy, client name, rate, and commission figure your agency enters remains your agency’s property. We claim no ownership of it.
You grant us only the license needed to run the service for you: to store your data, process it, display it back to you, and back it up. That license exists for your benefit and ends when your data is deleted.
We will not:
- sell your data, or your clients’ data, to anyone
- use it to train machine-learning models
- share it with another agency, except through the anonymous benchmark in section 9, and only if you switch that on
- use it for any purpose other than providing and improving the service to you
4. SMS Communications & Mobile Messaging
- CommishPulse may send appointment confirmations, updates, and reminder messages to customers after they fill out the opt-in form with CommishPulse LLC through the website and also have the option to receive marketing and promotional messages, including special offers, discounts, and new product updates.
- You can cancel the SMS service at any time. Just text “STOP” to 405-445-4565. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

- Carriers are not liable for delayed or undelivered messages
- As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

5. What you are responsible for
You are the party with the client relationship, and some obligations sit with you rather than with us:
- Lawful basis. You confirm you have the right to put your clients’ information into CommishPulse and to have us process it on your behalf.
- Your producers. You are responsible for telling the people you add what the software records about them — which includes their commissions, and, if you enter them, their salary and burden.
- What you type. The notes field is free text. We do not read it or police it. Do not put information in it that you would not want stored.
- Accuracy of rates. We calculate from the rates you configure. A wrong rate produces a wrong figure, correctly.
6. Acceptable use
Do not use CommishPulse to break the law, to store data you have no right to, to attempt to reach another agency’s data, to probe or attack the service, to resell access, or to build a competing product from it. We may suspend an account being used this way, and we will tell you why.
7. Fees, seats and billing
Subscriptions are monthly, in advance, at the plan price shown when you subscribe. Payment is processed by Stripe; we never see your card.
Seats. Each plan includes a number of people. Everyone with an active account counts, whatever their role.
Going over. You can always add people beyond your plan. When you do, the extra accounts are created but restricted — those producers can sign in, but their figures are hidden until you move to a plan that covers them. Nothing is deleted and nothing is lost; upgrading restores the view immediately. We do this rather than blocking the addition, because an agency that has just hired someone should not be stopped mid-task by a billing screen.
Changes. Price changes take effect at your next renewal, and we will give you at least 30 days’ notice by email. Fees are exclusive of tax. Fees already paid are not refundable except where the law requires it.
Non-payment. If a payment fails, we will tell you and try again. If it stays unpaid, we may restrict access to the account. We will not delete your data for non-payment without telling you first and giving you a chance to export it.
8. Canceling
Cancel at any time; the subscription runs to the end of the period you have paid for and does not renew. We do not charge a cancellation fee.
Before you go, ask, and we will export your full book — every policy, producer and commission figure — to CSV within [10] business days, at no charge.
After cancellation, we keep your data for 90] days in case you come back, and then delete it. Support session and billing records are kept longer, as described in the Privacy Policy; they contain no client policy data.
9. Support access
Our staff can open a read-only view of your agency, as one of your users, to answer a support question. We tell you this in the contract rather than leaving it for you to discover.
- It is read-only, and that is enforced by the database, not by our restraint. A support session cannot alter a policy, a rate, or a commission figure — the database refuses the write.
- Every session is recorded: who, which agency, viewed as whom, when it started and ended, and why.
- The record is permanent and cannot be deleted from the interface.
If you would rather we ask first every time, tell us and we will.
10. Cross-agency benchmarks
Off unless you turn it on. When on, your producers’ totals join an anonymous distribution shared with other agencies in your state — a median, a quartile — with no names, no clients, no carriers and no agency attached. A cohort is only reported once at least three agencies and ten producers are in it. You can turn it off at any time, and exclude individual producers.
11. Availability
We work to keep CommishPulse available and we do not promise it always will be. There is no uptime guarantee in this agreement. We will give reasonable notice of planned maintenance where we can.
12. Age Limit
You must be 18 years of age or older to use this Site including SMS communications. By using this Site, you represent and warrant that you are 18 years of age or older.
13. Confidentiality
Each of us may learn things about the other that are not public. Neither will disclose the other’s confidential information except to people who need it and are bound to keep it confidential, or where the law compels disclosure.
Your data is your confidential information, and this obligation continues after the agreement ends.
14. Disclaimers and limits
Disclaimer. Except as stated in these terms, the service is provided “as is”. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent the law allows.
We are not liable for commission payments made in reliance on a figure in CommishPulse. Reconcile against carrier statements. Section 1 says this too, because it is the failure that would actually cost you money.
Limit. To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or lost business, even if warned they were possible. Our total liability under this agreement is limited to the fees you paid us in the twelve months before the claim arose.
Nothing here limits liability for fraud, wilful misconduct, or anything the law does not permit to be limited.
15. Indemnity
You will defend and indemnify us against third-party claims arising from data you put into the service that you had no right to put there, or from your use of the service in breach of these terms. We will defend and indemnify you against third-party claims that the service itself infringes their intellectual property.
16. Insurance data security
You are the insurance licensee; we are your third-party service provider. Where a state adoption of the NAIC Insurance Data Security Model Law requires you to bind your service providers by contract, these terms are intended to be that contract, together with the Privacy Policy. We will sign your own vendor agreement or data processing addendum instead if you prefer.
We handle client information as nonpublic personal information under the Gramm-Leach-Bliley Act, and use it only to provide the service to you.
17. Suspension and termination
We may suspend or end an account for breach of section 5, for non-payment after notice, or if required by law. Except where the law or a serious breach makes it impossible, we will tell you first and give you a chance to export your data.
You may terminate at any time under section 7.
18. Changes to these terms
We may change these terms. For a material change, we will email account owners at least 30 days beforehand. If you do not accept it, cancel before it takes effect, and we will refund the unused part of your current period — which is a departure from section 6, and deliberate: a change you did not agree to should not cost you money.
19. General
Governing law. The laws of the State of Oklahoma, without regard to conflict of laws rules. Disputes go to the state or federal courts located in Oklahoma, and both parties consent to that venue.
Entire agreement. These terms and the Privacy Policy constitute the entire agreement between us and supersede any prior agreements.
Severability. If a provision is unenforceable, the rest stands.
No waiver. Not enforcing a term once does not waive it.
Assignment. You may not assign this agreement without our consent, except to a successor to your business. We may assign it to a successor to ours, and will tell you.
